Legal Question in Family Law in Illinois

Child support when the father re-marries

Hi.

My question is: if a man gets re-married and is currently paying child support. Can the child support be calculated off of his new wife's income?

Situation: My current boyfriend is paying child support, we live together but are not married, I am a full time nursing student.

My concern: the ex wife will try to increase the amount of support he pays off of my income once I graduate as a RN, BSN.

Thanks for your prompt response

Re: Child support when the father re-marries

Hello. I have been asked this question many

times before by clients. My answer is no. If

you and your boyfriend decide to marry, the court

cannot include your income to determine the amount

of child support that your boyfriend will pay. There are two other issues here that need to

be considered. I will be happy to answer any

additional questions that you might have!
