Legal Question in Family Law in Illinois

Child support

My husband's divorce was final in 1999. He pays child support for two children. Now, four years later, the percentage for calculating child support for two children has gone up. Is it the practice of the Illinois Child Support Services to notify custodial parents of any increases? Moreover, if the ex wife did want to increase CS, would she still have to the petition the court for the increase?

Re: Child support

Any change in child support must be done by the court. Your husband will be notified in writing by teh court or the ex. The basis for a change is "a substantial change in circumstances". In most cases it is an increase in wages over a 20% change either way.

I can help you in the event that your husband's ex tries to get more.
