Legal Question in Family Law in Illinois

Child Support in Illinois

My husband pays child support for his two children. His ex wife worked the entire time they were married and they earned approximately the same amount. She has already taken him back to court once to raise the amount paid to the statutory 28%. She is remarried and has now elected to quit her full time job taking a part time job that pays substantially less. If she tries to take him back to court for more child support, are there any repercussions for her electing to take a lower paying job? How can she make the case that she needs more money when she decided to take a job that pays her half of what she was earning before?

Re: Child Support in Illinois

Hello. By law, the amount of child

support your husband pays is based upon his net income; not that of his

children's mother. Will be happy to discuss this further and in more detail.
