Legal Question in Family Law in Illinois
Child Support Increase Petition
I live in Illinois. My 15 year old daughter told her mother she wanted to live with me. Her mother reacted badly, cussing and screaming and breaking a window. My daughter came to my home and she requested I file to make the chnage permanent. When her mother received the paperwork she freaked and manipulated the child into returning to her mothers home. The next day my daughter returned and her mother called the police and declared her a runaway. Did I mention I live 2 doors down from my ex? My daughter was forced to return home since her mother told the police she was not allowed to stay with me. Now my ex has filed a petition to increase child support. I am not against it if my daughter is living there since 20% is the law. The problem is the petition is wrong. My ex and her attorney stated that child support has not been increased since our divorce in 1996 and that is not true. In fact is was increased in August 2002 by the same attorney she has right now. Should this be brought to their attention?

Re: Child Support Increase Petition
You need an attorney. If you are fighting against an attorney, you will lose.
You can get custody of your daughter with the proper filing in court. You can prevent increases in child support. In fact, once the child is in your custody, you can request child support from your ex-wife.
I just handled a similar case earlier this year. From what you described, time is of the essence. Feel free to give me a call for a free consultation, and I'll be more than happy to speak with you about your situation.
Best of luck!
