Legal Question in Family Law in Illinois

child support and maintanance

I have been married for 7yrs and I am considering divorce. I have been a stay at home mom for 6 yrs and we have 2 minor children. My husband told me if he ever leaves me, he will leave me with nothing. My car is in his name, the house is in his name but I am on the deed. I started working in Sept. but it is not enough to support my children. He makes $200k a year and our home is in foreclosure. Our car are up for repo. He controls all of our finances. What are my options? Do I have any??Please help

Re: child support and maintanance

well, you do not have to worry about finding the ability to pay for the divorce or for maintenance. Illinois law allows for spouses in your situation to ask the court for the other spouse to pay for your attorney's legal fees. For example, our firm often handles cases in which we are paid by the other spouse because our client was not the breadwinner in the relationship.

Additionally, there is simply nothing that he can do to prevent paying child support to you in the likely event you are awarded custody. Ballpark amount is $64K just in child support. As to the foreclosure, if you file for a divorce, the foreclosure action would be halted until after the divorce and our firm would make sure that the divorce settlement made arrangements for the home to be paid.

I hoped I gave you a quick rundown to your major questions. I would be more than happy to speak with you over the phone or via email at no charge to go over your case in better detail and tell you what your options are. Feel free to email me the best way to reach you during the day.

Lastly, I can assure you that you have options, and you will NOT be left with nothing.
