child support

If I was to marry a man that has to pay child support to his former spouse, after we are married will my income have to be figured in as to how much he has to pay to his former spouse . That is if she was to take him back to court for child support amendments .

Would either my earned income from working or what I recive as child support for my children from a previous marriage?

Hello. This is a question that I am frequently

asked. No, your income is not figured into the

child support calculations; only your husband's

income is used to calculate child support. Let's

suppose that your husband earns $3,500/month,

after taxes, and has 2 children by his pre-

vious marriage. The court, in Illinois, will

use the statutory guideline of 25%

(.25 x $3,500 = $875). This is what your husband will be obligated to pay monthly as and for child support, if these were the facts. I handle a lot of cases like this. I hope this information is helpful to you.
