Legal Question in Family Law in Illinois

Child Support

I am currently paying back child support on my 5 yr. old daughter. Now I have taken my ex-girlfriend to court to find out if the seven yr. old is mine. He is mine and I am trying to get visitation on both since she hasn't let me see them at all for the past year and before that she only let me see one of my children once a month for an hour. It was always supervised by her and I never got to see my child more than that.I have recently married and my wife is now pregnant, I'm going back to court at the end of this month for visitation rights. How are they going to calculate the child support now that I've found out that the seven yr. old is mine? Will they take into account my unborn child with my wife, even though she hasn't given birth yet? And will they need to see my pay stubs again to determine for two children now?

Re: Child Support

You should bring your pay stubs and you should mention that you have a wife and unborn child. But the minimum in Illinois is usually 28% of your income for support of two children except in unusual circumstances.

You would probably benefit from an attorney to help you sort out some of these issues, please feel free to call us to talk more.
