Legal Question in Family Law in Illinois

Child Support Payment Calculations

I've been divorced since November of 2001. My original child support payments were calculated using an average of my previous three years of income. (I was self employed) I am no longer self employed and my income has dropped significantly. I've been told that the original payment calculation could not be changed for two years. Is that correct? I have three children. Could the payment percentage of 32% be calculated after each year's income?

Re: Child Support Payment Calculations

No. The standard the court looks to when deciding if a change in child support is appropriate is if there was a "significant change in circumstances." A change of 10 to 20% in income may qualify you for a reduction based upon other factors. Speak to an attorney to see how those factors shake out in your case.

Best of luck!
