Legal Question in Family Law in Illinois

child support payments

I gave up my parental rights. My son lives with his aunt without any state funding. The state is still garnishing my checks. Why do I still have to pay support when nobody is getting the money? This has been going on since 1988 or around there. Also, if I'm not suppose to be paying support, am I entitled to get this money back and how do I get it? Thank You

Re: child support payments

Without the relevant orders and other documents, it's difficult to know your situation and give advice. When you "gave up your parental rights", are you certain that child support obligations were removed? If the state merely took temporary guardianship of the children, you may be obligated to the state for the support of the children. Who is taking the support money? Probably the state. You can find out by checking with the agency involved, perhaps Children & Family Services. Check the paperwork, determine which agencies are involved, then contact them with your case number to get the information.
