Legal Question in Family Law in Illinois

child support/college

daughter will be turning 18 in July, has been accepted to a state college-receiving financial aid (based on my income) to cover tuition/rm/board. Divorce decree says parents split college exp. equally. I've already paid for 3 college courses, books, etc. Have not had child support modified in 10 years. Is it possible to have ex's child support obligation extended through college? if so, can it be paid directly to her?

College expenses are not child support...the law treats it as a totally different animal so to speak. Essentially a court looks at the ability of the spouses to pay these expenses at the time the student is of college age. So essentially it will be a breakdown looking at your respective incomes/assets right now. It's Section 513 of the Marriage and Dissolution of Marriage Act.
