child support-workers comp claim

My ex is trying to get child support termated-reduced due to him not working but is in the middle of a workers comp claim. I think my lawyer is taking me for a ride due to the fact we have been in and out of court for over 1 year. Is it standart procedure to petition payment from workers comp if ex has a claim instead of fighting over the abatement?

Not exactly sure where your case is procedurally, but worker's compensation IS "net income" which child support is based on. It's possible that there might be some interim period which child support would stop but once the workers comp. stuff is settled then support should resumed based on his then current "net income" from workers comp.
