Legal Question in Family Law in Illinois

child visation

I have full custody of my son. we live in IL. He is going to 12 in April this year.

He does not like visiting his mom in South Carolina.

How old does he have to be to be able to not have to go on visitation?

Re: child visation

Hello. This is a sensitive topic. In

Illinois the courts handle this issue

on a case by case basis. Generally

Illinois courts will lean toward encouraging a child to spend time with both parents, unless there is

clear evidence that one or both parents will put the child at risk.

There really is no "magic age" per se. However, I do suggests

that you bring this issue to the

court's attention. If the situation

warrants, the court can order mom to

counseling before she can visit with

your child, assuming she will put your

child at risk when in her presence.

Will be happy to discuss this with

you further and in more detail.
