Child Visitation

My child father had missed his first three scheduled visitations. He showed up to this one and things were going fine until I received a frantic call and several e-mails from my daughter. She has asthma I told him what the dosage should be he doubled the dosage. He left her with a stranger who's son started to bully her and hit her. I called father to ask what was going on he never called me back. So I requested a police escort and went to his home and picked up my child. I found out the he had my daughter to sleep in the bed with this 11 yerar old little boy who is not a relative. Then I received several phone calss that I have tapped with him threating me. We go to court on Nov.13, but my daughter is scheduled to visit with him Nov 7 can I not show up for the Nov.7 visit? I want to go to court and ask for mediation before we continue these visits. Is that against the law?

I would suggest that you request a temporary stop of visitation or at least get the visitation supervised. I'd say you certainly have some "serious endangerment" that will allow you to restrict the father's visitation. Depending on the nature of the father's threats against you, an Order for Protection also might be in Order. If you act in the next week or so I'd guess that you could get into court before 11/7 or quite frankly I think your situation would justify an "emergency" motion where you can get into court immediately.
