Child wanting to stay with non-custodial parent , child is 16 years-old

The child is a 16-year-old and wanting to come live with her father. Her mother has custodial supervision and is recieving child support from the father. The child has been staying with the father for 1 1/2 weeks. She is having problems at her mother's house with the step-father. The mother had made a comment to the father and step-mother about the daughter staying with the father for 2 weeks and seeing what happens. Now the daughter does not want to return to her mother and wants to stay with the father. What legal rights does the father have and what legallities will have to be gone through for the daughter to stay. We want to make it as simple on the child as possible.

The court can decide whats in the best interest of the child. Dad would need to file a petiton for change of custody. I can help
