Legal Question in Family Law in Illinois

My children's father and I have joint-custody and he refuses to let me have any contact with my children. He says I abandoned them therefore I have no rights to them, I got all the paperwork from the courthouse and it says nothing about abandonment anywhere. He has done this for 5 years now and I am fed up but don't have the money to hire an attorney. What can I do legally?

Hiring an attorney is a personal choice. However you are free to proceed pro se. Doing nothing, obviously, solves nothing.

Nobody but a judge can change a court order. Therefore, if the father of your children is interpreting your joint parenting agreement so as to include terms that do not exist, you should bring that matter before a judge. You probalby should consult with an attorney about this. It sounds as if this might be fodder for what is known as a petition for rule to show cause. In essence, you would inform the court about what the father is doing and ask that he be stopped. However, if I knew more facts about what is going on I may change my opinion. Finally, why have you waited 5 years to pursue this? Good luck and I hope you are able to see your children.
