I had a baby with a guy who I thought was the father. We signed the Voluntary Acknowledgment of Paternity. I recently signed the rescission to cancel it. My son has this man's last name and I want to change it to mine. I have no job, is there any way to do this without spending a fortune on the court order and without the biological father's consent if I do not know who it is?

Hello, you probably can get the relief you are seeking from the Office of the State's Attorney in the county where you live. However, to answer your question; you would have to notify the biological father in the event that he is the father and you wish to change your child's name.
Again, I recommend that you contact the office of the State's Attorney in your county and get that office to help. If this gentleman is the father, he needs to be under an order making him pay child support, until your child reaches the age of 18. The law will then require that he contribute to your child's college education costs based upon his ability to pay while your child attends college.
