Legal Question in Family Law in Illinois
cohabitation
My friend and I are living together. This is primarily due to finance issues as he is still paying for all the marital expenses. He is in the final stages of divorce. If his soon to be ex-wife should find out this arrangement, would this impact on his alimony support? My income is not co-mingled with his. I own the residence where he is living with me. Also, if we should marry post-dissolution, would this impact his future alimony support, i.e. increased income because of my contribution?

Alimony and cohabitation
Maintenance (alimony) is based upon a number of factors, and the needs and financial resources of the parties is among them. In this case, having ones living expenses partially defrayed (i.e., living for free with you) or shared with someone else (e.g., utility costs, food costs, etc.) reduces your friends needs and improves his financial picture. Although your income is not considered as his income, your income reduces the amount he needs to live. Thats common sense. Marriage to you wouldnt change that.
