Legal Question in Family Law in Illinois
college funds for children after divorce
I've been divorced 6 years.
we never addressed the college funds
for our 5 kids during the divorce.
Since the divorce I have not
contributed to the funds. My
daughter is now graduating from
college and I would like to have the
college funds divided up. (I believe I
am entitled to half of the amount
from the date of divorce) so I can
help pay off their college loans and
give a monetary gift. My exhusband
has never let me have access to
these accounts because when we
were married they were put in his
name as custodian. I don't even
know the amount that was in them
when we divorced. What I would like
to know is: Am I entitled to half the
amount of the college funds since the
a date of divorce(since I haven't
contributed since, I wouldn't want
anymore) to set up my own accounts
for the kids so I have something to
give them?
Is this a sure win for me because I
don't have the money to keep going
to court. Is this pretty
straightforward case?

Re: college funds for children after divorce
Im confused. Why would you want money from a college fund dedicated to your children? Especially if you did not contribute? This sounds unusual, perhaps I so not understand the question. As long as the kids are getting the money, I doubt the court will let you have control over money that you are not contributing.
