Compensation for Attorney Fees
My wife's ex-husband recently filed a petition to modify child custody based on a significant change in circumstances, namely false allegations of abuse toward the children from their marriage on my part. This is completely false. My wife has custody and he has visitation. We now live in a neighboring state. Our attorney successfully got the location changed to the county we now reside in. My wife has custody and he has visitation. We now live in a neighboring state. His petition to modify custody was filled with blatent lies such as multiple police visits to the house which never happened, and supposed conversations with school officials who contacted him regarding concerns over possible abuse. The school officials denied making any such comments to him in any way, and assured us they have no such concerns. We have now spent around 3-4K on attorney fees on this. There is no evidence he is pursing this case in our county. Can he be held responsible for our attorney fees in defending such false allegations, which we can prove are false by the very people he claimed to support his allegations in the petion. If so, would we file in our county, where the case has been moved, or in the county the case was originally filed? Thank-you

If you have an attorney I suggest you check with them on the points you have identified. Your situation sounds far too complicated for an off the cuff opinion. The chances of getting attorney's fees are small. You can ask, it never hurts.
