Legal Question in Family Law in Illinois

I'm contemplating divorce. I would like to move out; will the fact that I left/moved out be a negative in the divorce process. Should I take half the money from our joint checking acct? Bottom line- what is the first couple things I should do if I want to move towards a divorce.

No, moving out is not a problem - UNLESS you leave the children behind and you were the primary parent. You do not surrender rights in the home by moving out to an apartment for example. You can take the funds from the checking account, rest assured this will be accounted for later in the case - meaning it will count toward your share of the marital assets.
