Legal Question in Family Law in Illinois

Contemplating Divorce

I am thinking about getting divorced.

I have been married 5 years. My wife and I are 31. We have 2 children age 2 and 6 months.

We own a house with $25000 of equity and virtually no other assets or other debts.

My wife worked part time until our second child was born and is now a stay at home Mom.

I earn $80000 per year.

If I get divorced what would I have to pay for child support and Alimony?

Re: Contemplating Divorce

Child support and alimony are dependent on a number of factors.

In Illinois, one of the most important factors for child support is that the law states that a court will set child support for two children at no less than 28% of the non-custodial parent's net income unless there is a good reason to do otherwise.

The amount and duration of alimony are based on a number of factors, most of which are intuitive. However, the large number of factors makes it impossible to predict precisely what the actual alimony will be.

Note that also, barring an agreement otherwise, alimony may be later modified, especially if circumstances materially change after the divorce decree is entered.
