Legal Question in Family Law in Illinois
court documents to file
I recently went to court over child support issues, and while there I tried to tell the judge that my ex filed both children on his income tax this year even though, for 13 years, we have always claimed 1 each. This is stated in our divorce and has never been amended or changed. The judge told me I have to file a paper with the court, stating this, but I don't know what document I am suppose to use or what to write. Can you possibly help?

Re: court documents to file
If by fiing both children as dependents on his income tax return, your ex violated the court's orders,
you should file a petition for rule to show cause against your ex as
to why he should not be held in contempt of court for violating the court order. This is tricky. You really should have a lawyer do this, in my opinion. I will be happy to discuss this further and in more detail.
