Legal Question in Family Law in Illinois

Court orders not followed

In the final divorce my ex husband was ordered to pay 1/2 of the daycare expeses and a balance on a credit card. He neglected to pay the credit card so I had to do it to protect my credit. He has not paid daycare in over a year. He is on unemployment now. Am I still entitled to collect the balance that he owes me and how?

Re: Court orders not followed

Hello! You are indeed

entitled to the balance

due from your ex-husband.

First of all, you need a

lawyer. Secondly, a

petition for rule to show

cause as to why he should not

be held in contempt of court

for violation of the court

order should be filed.

Thirdly, the court should

be asked to put him on

its job search program

where he would have to come

into court once each week

with a job diary showing

where he had looked for

employment, and the results.

I hope this information

helps.
