Legal Question in Family Law in Illinois
Can You Get Credit for Payments Made to Mother for Child Support
I was wondering if you can receive credit from Illinois Department of Public Aid for payments made to the mother for child support. I continued to make court ordered payments to the mother over the years even though I was self-employed. I thought that if I made the payments to her I was in conplience with the court order. I was NEVER informed that I had to send the payments to the Agency. Through the years I NEVER received ANY letters of arrearage or to send the money to the Agency. Unfortunately, my business venture did not work out and I was forced to file for bankruptcy and at the time I saw my credit report with arrearage totally $4,000.00 from 1993 to 2000. I sent money by way of Money Gram...Western Union...Wire Transfers just to name a few totally over $10,000.00. The mother even informed the Agency that I was sending money on a monthly bases. I was told that you are entitled to a one time credit for monies paid the legal guardian and I was wondering if this is true. I have ALL my receipts as well as the letter sent by the Mom to the Agency. So what do you think my options are? I would like to get credit for the payments made to the mother because they are taking my income tax returns. Can you help? Thank you.
