custodial rights

in the state of illinois, is it legal for the husband to leave the state with his nine week old baby without his wifes concent?

It depends. If there is no order prohibiting the movement, and there is no effort by the husband to hide the baby, and he is coming back in a reasonable time period, he is probably ok. If he takes the baby in the process of divorcing the wife, and intends to hide where the baby is, that is not good.
