Custody Case

I am currently in my third trimester and the father of my child left me when i was only 9 weeks pregnant and has not contacted me since my 12th week. I have a possible domenstic violence charge on him and a photographic evidence of the injury. He claims he and his family want half custody, does he have this right? I have currently found myself with someone new and we are looking to move to Nebraska with his family, only if the biological father does not get half custody.

You need to get an order from the court for residential custody and request to move out of the state. All this requires Petitions from the court. He is entitled to visitation, but given the circumstances, the judge may very well find the childs interest in living in NE with your family is better than the alternative. These cases are fact intensive and require going before the judge and arguing the case, sometimes several hearings.
