Legal Question in Family Law in Illinois

custody

I have 3 children ages, 15 1/2 11 and 10 and I have been separted from my husband for 3 years and he has the children if my 15 1/5 year old decided he wanted to live with me is there anything my husband can do to stop it from happening since there is no divorce paper or custody aggrement signed yet?

First, with no court file, you and your husband are playing with fire.

You need to hire an attorney, file a petition to establish custody, and visitation. A 15 1/2 year old can pretty much determine where he wants to live, assuming both parents are suitable. But expect the father to fight this, which is why I recommend getting a family law attorney. Custody fights are not short or simple. Let me know if you have any further questions.
