Getting custody of my 2 children

My kids mother and my 3 yr old son died in a car crash in 2003 my other 2 children survived the accident the state granted custody to their grandmother because she said she didnt know where i was. I was going to file for custody then but it seemed it would be a big mess seing that the court told me that there is a grandparent law. Since then my kids have been mistreated and want to come to live with me,I got into a little legall trouble 2 yrs ago and have been on probation ever since, but not in trouble since. I filed for a court hearing and we are scheduled to appear in court. Considering that i am their only living parent how much of a problem would i have getting custody of my kids? and do I really need a lawyer like everyone says.(I am the only one on this earth that is 50% their blood) I now reside in minnesota, and they stay in Illinois, would i have to get a lawyer from Ill or MN if needed?
