Legal Question in Family Law in Illinois

Custody

My husband moved out the house in september and says he want a divorce. When we moved into our house 4 yrs ago it was agreed that it was temporary and we would move when our daughter went to H.S. so that she could go to a good H.S. He moved to the area we agreed to relocate to and I can't afford to move to the area. He wants her to use his address for school but says the school need a noterize letter stating she lives with him. The kids stay with me and I want to know what the affects this letter would have once he files for a divorce? Are there any alteratives availble other then giving up custody of may kids?

Re: Custody

Hello. Be very careful about giving dad that

letter. If he files for divorce, he could

be awarded custody of your child because the

courts tend to go with the status quo. You

need representation to deal with this issue

as well as the overall custody situation with

your children. If you do not want a divorce,

you should at least file a petition for legal

separation so a court can get involved. I will

be happy to answer any additional questions that

you might have.
