Legal Question in Family Law in Illinois

Custody Reversal in Illinois

I have had sole custody of my two children ever since my divorce over five years ago. I have lived in the same house, the kids have attended the same school, I have had the same job and same boyfriend (who lives with us) for the past four and a half years.

My exhusband has been somewhat consistent with his visitation; but not always. In 2003, he moved out of state for six months to live with a woman he met online. It did not work out so he moved back to this state. He has had at least six or seven girlfriends and periods of unemployment during the past five years. He lived in his parents' basement until 2004, when he met and married a very wealthy woman. They bought a home near me and have now decided to go for sole custody of our children.

I should add my ex-husband has a jail record and has anger management issues as well.

My instincts tell me I have nothing to worry about. My boyfriend and I do not smoke, do drugs, or drink; we do not abuse the kids in any way and while it hasn't always been a smooth ride as a blended family, we're doing pretty good.

What are the chances he could get custody, and what circumstances could he claim it necessary?

You really do not have anything to worry about other than the ex's new found money. That buys lots of attorney help and could mean you have to now defend your custody against his ability to pay for lawyers. Despite his money I do not see as to how you are going to have problems with custody. The court will decide what is in the best interest of your children.

At this point you would have had to do something that would cause you to be questioned as a parent. I can help you in the event that the ex decides to try something. I would ask that you call me for a free consultation.
