Legal Question in Family Law in Illinois

custody rights

My ex-fiancee and I have a 1yr old daughter. He says he has a legal right to show up at my house anytime he wants, beacuse he is the father. I want to know if this is true.

Re: custody rights

Hello and Happy New Year. If your

ex-fiance has not been legally declared the father of your child,

you should immediately file a paternity suit against him. This will

get the process started for you to

receive the proper amount of child support and then visitation can be

appropriately arranged by the Court.

This will eliminate his unexpected

visits which will certainly lead to

trouble. Otherwise, without an order

declaring him the father, legally he

has no rights to the child and has

no rights of visitation. I will be

happy to discuss this with you further

and in more detail.
