Legal Question in Family Law in Illinois

Custody Rights

I am the father of a 7 year old in the Chicago area. The mother is mentally unstable and moved back to Michigan with her parents. If she is agreeable to me having our daughter during the school year and her (under her parents supervision) having our daughter during the summers - should I be going for Joint Custody or Sole Custody?

Re: Custody Rights

Well, the more important issue is you want to be the residential parent. I am not sure of all the facts here, but I would be ok with joint custody as long as you were the residential parent and had control of the child's visitation through the child visitation order. Joint custody with 'tie-breaker' power is easier to get everyone to go along with and gives you what you really want in the end.
