dad wants custody

my new husband and i live in missouri, his daughter lives in illinois with her mom. the situation is not good. his ex does not have a job, has 3 children by different fathers, lives in a 2 bedrrom house with the 3 kids, and her best friend and herself, and the children sleep on the couch. the education level where they live is poor, and there is a whole lot of lying and manipulation on the mother's part...his daughter loves it here, and says she wants to live with us...she is 6..also, there is no legal document giving my husband visitation (it has been at her will, and changes on her whim). she is recently divorced, and had just gone out of state to meet strangers off of the internet...this is just the beginning. anyway, we would love to have custody...any advice?

Hello. I suggests you hire an Illinois attorney

to file a petition for change of custody. The Court will appoint a child representative and

a psychologist to evaluate the child in question.

Your post does not tell us whether your husband was divorced from his daughter's mother, or whether he was legally determined to be the father by a court in a paternity suit or by an administrative child support proceeding. Also, we do not know exactly where in Illinois the mother resides. This information might effect the nature of advice you need. I have handled hundreds of such domestic cases in Missouri, and also a substantial number in Illinois, and so I believe that I could at least offer some assistance.
