Legal Question in Family Law in Illinois

Daughter has child she raised herself for 6.5 years. Never married father. Never had a court order for paternity/child support/visitation. He'd give her $$ when it was convenient for him and visit child when it was convenient. 3 months ago she asked him for a favor which was to put child in school where he lived because her lease was up in 1.5 months and she didn't know where she'd move to. He obliged w/o hesitation. He is a young father (26). Recently he got upset because my grandson had day off of school and the father didn't know where he'd put him for the day. Last week he dropped off child by my house and said if she didn't return him that sunday, he'd charge her with kidnapping and had already covered this with his lawyer and police. I honestly think he's bluffing. My daughter found on apt and didn't return her own son that she raised on her own. Father of child called police and made a kidnapping complaint. I feel he doesn't have a case.

Having dealt with many cases with similar facts, my first piece of advice is simple: YOU MUST GET AN ATTORNEY!

It appears that the father has an attorney, your daughter has no legal order or agreement attesting to her being the residential parent, your daughter is entitled to child support, and essentially its a he said/she said. Your daughter has to be very careful here. Whether you call my firm or another firm, I strongly advise you to have you / or your daughter consult an attorney. Let me know if you have any other questions.
