Legal Question in Family Law in Illinois
My daughter (10 yrs old) wants to move in with me because she has been forced to move into my son's (13 yrs old with autism) room at their mom's house. At what age can she make that decision (to move in with me)?

18. Seriously, there is no set age at which a child's wishes are taken into consideration. The better question is whether where she sleeps is in the best interest. Why is it being done. Is she placed in danger because of the placement. Is she is, then you can seek custody, but the vagaries of a 13 year old's desire would not be sufficient.
