Legal Question in Family Law in Illinois
DCFS is keeping things from us
My daughter inlaw gave up our grandson to a family friend and said she signed over her rights to her. but my son is still married to her but dcfs got called in on her and thats why she gave him up now the one whom has guardianship of him wants to keep him and is keeping us from him all together. Because the mother made a so called safety plan dcfs said that we cannot remove the baby from that. So what can my son do to get his baby back before they find someway to take away his prental rights?

Having just finished a fight with DCFS, I can say you need to be aggressive with these people. First, it is possible that your son has unknowingly lost some or all of his rights. Part of your story doesn't make sense. If your son is still married to the mother, he should have had to sign something to give up guardianship to a 3rd party. If he did not sign the safety plan, he is not subject to it. This sounds complicated and you need to find a family law attorney and go over it with them.
