Debt from college loan for our child

I was married for 20 years. 9 years ago i got divorced and moved to california. while i was still married my ex-husband and i put our daughter through college, however, the debt was in my name only. since i have been divorced, i have been paying for the debt. my ex-husband has agreed to pay for half of the debt, and now is refusing to help pay it. the debt is $26,000. Our daughter is over 21 years old and a college graduate. do i have any legal course of action i can take to get him to pay his half of the debt? i live in california, my ex-husband lives in illinois.

I would have to look at the Marital Settlement Agreement, but generally, under a particular code, both parents are responsbile for continuing education for their children based on their financial situation.

Feel free to give me a call, and we can help you determine exactly what youre entitled for. Although you live in California, we may still be able to assist you.

You may have a civil suit for breach of contract, however, a consultation with an attorney would be necessary to determine whether or not all of the elements for a contract exitsted. Contact me directly.
