Legal Question in Family Law in Illinois

Debt Responsibility

My daughter is married and having difficulty financially. Her husband continues to rack up bills which she is unable to pay. She declared bankrupty two years ago before they got married.

Her name is not on any of the charge cards that he has but she is under the impression that since she is married to him she is responsible for his bills. (He has not worked for a month.) Is this correct? If she were to divorce him would that still be the case? She's afraid that if she files for divorce he'll declare bankrupty and then she'll be responsible for his debt.

Thank you for your consideration on this question.

Re: Debt Responsibility

There is a possibilty that she could be held responsible for the debt. This is true if the charges were for every day living items. For instance if the husband charged grocery items, or paid for utilities then she might be responible for this debt. She should consult an attorney ASAP because I doubt the situation is going to improve.
