deposition

my soon to be ex wife's lawyer is making me bring a deposition,in

person to his office at a specific date and time,it is far away, i will

need to take time off from work. am i legally obligated to do so?can

i fax it ?I do not have a lawyer anymore,ran out of money.thanks

I advise you to take the deposition seriously. If the particular time chosen by your wife�s attorney will not work, then call the lawyer and arrange a prompt alternate time. Do not blow off the whole thing. If your deposition is noticed up and you do not appear, you may be held liable for your wife�s attorney�s fees made necessary by your failure to appear (and you may face other sanctions too).

If the site of the deposition is too far away because it is outside the county where the case is filed, you should be able to get the location moved back to the county where the case is.

Be aware that, because you are a party to the suit, no subpoena is required to compel your appearance.

I am a little confused. If you have paperwork that you must present to an attorney then why don't you courier or otherwise mail it to his office. If it is important, you may want to fedex it. However, if you are stating that you must attend a deposition at his office, then you should have been delivered a subpoena from the court stating that you must attend the deposition. If you have been subpoenaed, then you must go.
