Dismissal of Court Date

I have sole custody of my son. My ex-husband has visitation but hasnt seen the child since our divorce. He is now filing Petition to Modify Custody order. I know he has to file with the state the child and I live in. But how do I get rid of the court date that he has in the state he lives in?

Greetings -

The court where you got your divorce is the court

that is still in charge even if you have moved out of state. Therefore, you are going to have

to deal with dad where he has filed, namely the

state where you got the divorce. It is best to

get a lawyer to handle this. Even if he is behind in child support, the court will consider

the issue of visitation and/or custody a whole

different matter. There is a three step approach
