Legal Question in Family Law in Illinois

Dividing assets with spouse and adult child

My husband and I agreed to each give our adult child 50000 for his college

fund. We will receive this money from the sale of our house. Is this enforceable

within our divorce settlement agreement, or do we each have to have our own

separate agreement with our adult child? My concern is that my husband may

verbally agree to pay his half, but refuse after the divorce is over.

Re: Dividing assets with spouse and adult child

Hello. I suggests that your divorce judgment

specify that the money be placed in a trust. In

this way the divorce judgment will enforce the

terms of this arrangement. In other words, if

dad does not cooperate later, you can go back

into the divorce court for relief. I will be

happy to answer any additional questions you may

have.
