Legal Question in Family Law in Illinois
Divorce because of adultery
I have had an affair with a woman
for almost the same amount of time i
was married to my wife 5 years ,we
have now been seperated 3 years
making it a total of 8 yrs she was
emotionally and mentally abusive i
was obese at the time and only
married her because I got her
pregnant, well she knew about my
girlfriend the whole time and even
agreed to excepting it as long as i
didnt leave her i have proof she sent
letters to me and my future wife
stating that on several occassions. I
am trying to get a divorce so that I
can marry my girlfriend the same
one I have been with and now have
a child by. How strong will the
adultery weigh in on this that will be
her main argument.

Re: Divorce because of adultery
Illinois is a no-fault State meaning that the reason the marriage broke down does not come into play when determining custody and division of marital assets.

Re: Divorce because of adultery
Well, it is completely ignored. In Illinois you don't need a "fault" reason like adultery. As to custody/visitation, it really only matters if there are unusual/risky behavior that could hurt the child.
In other words, don't let the adultery issue bother you.
