Legal Question in Family Law in Illinois
Divorce and Child support and income forms
I am in--name removed-- and I am getting a divorce and I am filling out a 13-3 affidavet, is so we can set up childsupport. Our codo is in foreclosure, I would love to try and save it, but in the mean time do I add the mortage to the monthly bills I have or that I am actuallty able to pay? Also my creditcards are also behind do I add those expenses too or leave them off the forms because I am not able to pay? My husband has an attorney and I am representing myself.

Re: Divorce and Child support and income forms
On the 13.3 affidavit it's typically best to slightly inflate your monthly expenses to make your monthly net income look on the low side. Who will have custody of the children? What sort of property is at issue? Anything? Is there any equity in the condo?
I'd like to hear more about your situation. It's dangerous to be in a case where the opposing party has a lawyer and you don't. Sometimes it has to be that way but the old adage is that if there are children and/or any property to divide you should have a lawyer. Simply failing to know what "net income" means for child support purposes can add up to a lot of money over time depending how young/old the child/children are.
