Legal Question in Family Law in Illinois

my divorce decree says I pay child support until 18, and all college expenses for 4 yr degree, plus living, food, spending money, cloths, travel etc. My daughter graduated high school a year early and is starting college @ 17 so I have to pay both for a year. Doesn't seem right.

Typically, your daughter will be considered emancipated for purposes of child support and you are responsible for the college expense portion of the decree. However, often child support will continue unless otherwise ordered by the court because no action is taken on the part of the paying parent (especially in cases where payment is automatically withheld by the state dispursement unit). If your daughter will be starting school this fall, it would be wise to act as soon as possible so that the proper modification is in place. Modifications take some time to process through the court and other govt. agencies (if applicable). It would be wise to discuss the specifics with an attorney to come up with a game plan.
