Legal Question in Family Law in Illinois

divorce

My husband walked out on me 9/22/2006 and soon made it known that he had another woman. By mutual agreement, he was the one responsible for our mortgage payments. When he left I was summoned to court for foreclosure in which I found out he had not paid it in a year and had been lying. On top of that he left me with several loans and other bills that were in my name and both our names. I had to sell the house to my mother quickly becuase I was not left with much time before the house had an active sale date to do anything else. He refuses my phone calls and I want to file for divorce ASAP in attempt to piece my life together. Am I able to get all the money owed to me from bills and the mortgage payments as a part of our divorce decree? Although we have no children together, I want to seek financial relief seeing I have been borrowing money just to survive? If I have tried to reconsile and can not afford an attorney and he lives with his parents, can I include all attorney fees with the money owed to me from the bills? Thanks

Re: divorce

You can find some financial relief. However, your husband is entitled to half of all the marital assets (house). He might be ordered to reimburse your attorney's fees, especially if he earns far more than you do. Everything is negotiable. You may be able to offset what you have had to pay out against anything he is entitled to. This is just a quick answer to one question. Please do not regard this answer as legal advice. Your case is much more complicated. Please call for a free consultation.
