Legal Question in Family Law in Illinois
divorce law, Illinois
Does spouse support depend on length of separation? My wife wants a divorce after living apart for over three years. Is she entitiled to a large alimony? How much alimony am I required to pay? If she is in school and working part time will that increase the support amount? Can debts be split up equally? She don't want to pay on loans taken when we were together. Can she do that? Is spouse support dependent on the conditions of the breakup? She put me out the house but claims I left or abandoned her. Our kids are grown. What all does spouse support take into account? Can the fact that she will graduate from college this summer be considered in the spouse support amount? How long does spouse support last?

You have a lot of alimony/maintenance questions. There is no firm rules in IL regarding Maintenance and it is a very fact specific investigation by the court. In other words, the judge will hear all the facts, list to the arguments, and come up with what he thinks is fair.
