divorce and lawsuit settlement

If I get divorced and am going to recieve a settlement from workmans comp. and we have no propertor children between each other can my spouse take any of my settlement?

Generally no; the wc award is personal, for work-related injuries suffered by you in compensation for those injuries. However, if you get the settlement and spend it on property (home, furniture, auto, etc.), it may be considered marital property. If you are required to pay alimony, it will come from whatever income and property you have. If divorce is possibility, make the decision and file before you obtain the settlement. If it is significant, you are advised to consult with a family law attorney re legal options for your specific situation.
