Legal Question in Family Law in Illinois

divorce - maintenance

I agreed to 3 years of maintence on top of child support when I got divorced. The 3 years are now up and I'm not sure what steps I need to take to stop the maintence from coming out of my pay check.

Re: divorce - maintenance

Hello. First, you should file a motion to terminate maintenance based upon the plain language of your judgment of dissolution of marriage. Second, you should then send a notice of motion and the motion to your former spouse and you should also deliver a courtesy copy to the assigned judge. I do not suggests that you attempt to do this on your own or pro se. A lawyer of your choosing should be retained to do this because the process can be tricky and any error could cost you financially. Of course you should act on this quickly. Will be happy to answer any additional questions you may have.
