Legal Question in Family Law in Illinois

divorce

My nephew's fiancee currently owes $70K in student loans and is contemplating another $20-30K loan to earn her Master's degree after they get married next year. What portion if any of those amounts would he be liable for if they were to get divorced? Thanks for your help!

Re: divorce

Hello. In my opinion, your nephew will not be liable on the debts that his future wife owes prior to their marriage. The 20-30k that is contemplated for her to earn her Master's Degree will also not be his obligation, in my opinion, unless he agrees in writing to assume responsibility for the debt. Sounds like they could benefit from an Antennuptial Agreement. This will clarify the issues and allow them to fully experience marital bliss. I will be happy to discuss this issue further and in more detail.
