Legal Question in Family Law in Illinois

divorce payment settlement?

My mother in law got a divorce and in the divorce papers her ex husband wrote he would pay her $10,000 for her to sign the name off the home title. She did. They have been divorced for 9 years and wants to know what the statue of limintations is to file a judgement against him in illinois. He has not paid a dime and does not plan to unless further action is taken.

Re: divorce payment settlement?

When something's included in a Judgment for Dissolution of Marriage there's no statute of limitations. The first step should be to enforce the Judgment against him through the use of a court's contempt power. Contempt means a court can punish someone for not following its Orders...people get put in jail for example. A step to consider would be to get a pure monetary judgment against him and then using tactics such as recording against real estate, bank account garnishment and wage deduction. What assets does the former husband have to go after...that's one thing to carefully consider.
